As a fertility lawyer, I’ve helped clients across the U.S. and internationally navigate everything from egg donation, to traditional and gestational surrogacy, to embryo disposition agreements, to confirmatory adoptions. I’ve been recognized as one of Maine’s 40 Under 40 for my work in reproductive rights and family formation, and I’ve contributed to landmark legal cases, including a New York Supreme Court decision that was the first of its kind recognizing three legal parents through assisted reproduction. Every family deserves to be legally recognized. Yes. First and foremost a surrogate will always have the right to bodily autonomy and to make decisions about herself and her pregnancy whether the surrogacy agreement states so or not. While the details of any surrogacy arrangement are governed by state law, and the laws of each state differ greatly in this respect, some things remain consistent across state lines, like the surrogate’s right to independent legal counsel of her choosing, and the surrogate’s right to reimbursement from the intended parents for all medical expenses related to the prenatal, birth, and postpartum periods. The specifics of your surrogacy arrangement will depend on your jurisdiction, your agency, and your personal circumstances.
